QQuestions:
Does the Personal Data Protection Act trace back to any offence in the past? Will legal actions be taken against mishandling of personal data before the Act took effect?
AReply

The Personal Data Protection Act, which came into effect on February 19th 2006, provides that it does not trace back to anything that took place beforehand, as a general principle. However, if a past offence has an ongoing consequence now, then whoever did it should co-operate by correcting the wrongful act as soon as possible, or the wrongful party may face claims from the adversely affected persons. Besides, the institution must also abide by Article 45 of the same Act.
