Given that such information (about salaries, performance at jobs, etc.) is sought with the approval of the employees concerned, in compliance with Article 6 of the Personal Data Protection Act, the personal data of the former employees may be supplied legally. In other words, other companies may, with the consent of your former employees, obtain or ask for the personal data of the employees. Therefore, you may supply the requested information without breaching the provisions of the Act. Apart from that, in order for you to handle your employees' personal data better in line with the Act, the PDPB recommends that you prepare your personal data collection statement, with which you can inform the employees of the type of personal data collected, purposes of collection and whether such data will be supplied to third parties, etc. The statement can also make it clear that, unless required by law, all disclosure of employees' data will be made with the employees' consent.
